Fulbrook Capital Management is among the newest entrants to the Funding industry. It is dedicated to the creation and management of investments in high stakes, meritorious, corporate litigation and arbitration claims. It is working within that portion of the industry which arranges individual funds of individual worthy cases.
Fulbrook’s portfolio includes cases having varying degrees of risk, returns, anticipated times to recovery and forms of investment. It is particularly focused on funding complex commercial claims in areas including: financial distress and insolvency; breach of contract, fraud; certain claims involving financial service entities; selected claims in international arbitration, covering a wide range, certain patent and IP claims; and selected specialty areas like whistle blower, insurance and reinsurance claims, and enforcement of international judgments.
Its investment criteria looks for claims needing between $1,000,000 and $10,000,000 for funding, with expected recoveries typically in excess of $50,000,000 to $100,000,000 (with a number in the billions), and with a timeline between investment and recovery of on the average about two to three years (with heavy front-loading of cases expected to have a year or less lifespan). Depending on the size and form of the fund’s investment, Fulbrook has a wide range of possible cost saving methods and experts, coupled with a similar number of pricing structures.
Fulbrook’s principals and key advisors are experienced in litigation finance and litigation risk assessment. Its Chairman, CEO and founder, Selvyn Seidel, is a successful and distinguished professional as a litigator and in the Funding universe. He has been intensely active in it for several years; and before that he had over 40 years of complex litigation experience. He is also the co-founder and former Chairman of Burford Group, the exclusive advisor to the publicly traded British fund. Since Burford went public in October 2009, it has become the largest institutional funder of commercial disputes in the world. Beyond Mr. Seidel, Fulbrook has assembled a formidable team and supporting network of institutional and individual specialists.
